A class action lawsuit entitled Layes, et al., v. RHP Properties, Inc., et al. is pending before the Middlesex Superior Court.  The lawsuit is a “Class Action” because Plaintiff is suing on behalf of other people with similar claims called “Class Members.”  The lawsuit alleges that Defendants, as the owners or operators of Chelmsford Commons, violated the Manufactured Housing Act and related landlord obligations by failing to maintain the fuel tanks or other oil heating system components that are located on some rented home sites and that are necessary for each site’s oil heating system to function properly.  Although Ms. Layes has already obtained a Court order requiring Defendants to provide these services at Chelmsford Commons, she now seeks compensation for herself and other Chelmsford Commons residents or tenants who did not receive these services from Defendants between April of 2011 and October of 2017 (“Class Period”).  If you paid rent for a Chelmsford Commons home site that relied on oil heat during the Class Period, you may be a Class Member whose rights are affected by the Class Action.
